Terms and conditions governing the use of the Elderwise platform, applications, and services.
Acceptance of Terms
By accessing or using the Elderwise platform, mobile applications, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our Services.
These Terms constitute a legally binding agreement between you and Elderwise Pte. Ltd. ("Elderwise", "we", "our", or "us"), a company incorporated in Singapore. By using our Services, you represent that you are at least 18 years of age or have the consent of a legal guardian.
Account Terms
To access certain features of our Services, you must create an account. When you create an account, you agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your account credentials, including your password
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorised access or use of your account
We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period, with reasonable notice where possible.
Permitted Use
You may use our Services only for their intended purposes. You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable laws or regulations
- Use AI-generated clinical summaries as a substitute for professional medical advice, diagnosis, or treatment
- Attempt to gain unauthorised access to any part of the Services or related systems
- Interfere with or disrupt the integrity or performance of the Services
- Reverse-engineer, decompile, or disassemble any aspect of the Services
- Upload or transmit viruses, malware, or other harmful code
- Collect or harvest personal information of other users without their consent
- Misrepresent your identity or affiliation with any person or entity
Medical Disclaimer: Elderwise is a health information tool designed to support, not replace, the relationship between caregivers, patients, and healthcare providers. Always seek the advice of a qualified healthcare professional for medical decisions.
Intellectual Property
The Services, including all content, features, functionality, software, text, graphics, logos, and design elements, are owned by Elderwise and are protected by international copyright, trademark, and other intellectual property laws.
You retain ownership of any data you submit through the Services, including health assessment data and personal information. By using the Services, you grant Elderwise a limited, non-exclusive licence to process your data solely for the purposes of providing and improving the Services, in accordance with our Privacy Policy.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any part of the Services without our prior written consent.
Limitation of Liability
To the maximum extent permitted by applicable law, Elderwise and its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, goodwill, or other intangible losses, arising from:
- Your use of, or inability to use, the Services
- Any decisions made or actions taken based on information provided through the Services
- Unauthorised access to or alteration of your data
- Any interruption or cessation of the Services
- Any errors, inaccuracies, or omissions in AI-generated content
Our total liability for any claim arising from these Terms or the Services shall not exceed the amount you paid to Elderwise in the twelve (12) months preceding the claim.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the Services shall first be resolved through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, it shall be submitted to the exclusive jurisdiction of the courts of Singapore.
Nothing in these Terms shall limit any rights you may have under applicable consumer protection laws in your jurisdiction that cannot be waived by agreement.
